WILL OF Ann CRICKMAY 1858

This is the last Will and Testament of me Ann Crickmay of Beccles, Widow.

I appoint my Son Edward Crickmay of Norwich Surgeon and Robert Jarman of Beccles aforesaid Printer Executors of this my Will

And I give and devise all those my messuages and heredits situate on Small Gate Street in Beccles aforesaid an all other my real Estate whatsoever unto the said Edward Crickmay and Robert Jarman their heirs and assigns (subject to the mortgage debts secured thereon). Upon trust that they or the survivor of them his heirs executors or administrators shall at their or his discretion sell the same either by public auction or private contract with full power to insert any stipulations as to title to buy in and rescind any contract and to resell without being responsible for any loss occasioned thereby and to do all such acts for effectuating any such sale as they, or he, shall think fit and empower my said Executors to call in and convert into money such part of my personal estate as shall not consist of money.

and I declare that they, or the survivor of them, his executors or administrators shall by and out of the moneys to arise from the ways and means aforesaid and of the money of which I shall die possessed, pay my funeral and testamentary expences and debts and then divide the residue thereof equally between my seven children (that is to say) Charles Crickmay, William Crickmay, Edward Crickmay, George Henry Crickmay, Anna Elizabeth Ewing, Emma Louisa Otley, and Ellen Harriet Jarman, and in case of the death of any of my said Sons either in my life or before his share of the said monies shall become payable leaving a Widow, then I bequeath the same share unto such Widow absolutely.

And I declare that my said Trustees or Trustee shall either forthwith convert into money my said real estate, or defer the sale thereof at his or their discretion, without being responsible for any loss to be occasioned thereby, and that until the same shall be sold it shall be lawful for the said Trustees or Trustee to let all, or any part, of the same premises for any term of years at such rent and in such manner in all respects as they or he shall think fit, and that until the said premises shall have been sold the said Trustees or Trustee, or the survivor of them, his executors or administrators, shall apply the net rents and profits of the same premises in such manner as I have before directed concerning the residue of my said estate, and I devise all estates vested in me as a Trustee or Mortgagee unto the said Edward Crickmay and Robert Jarman their heirs and assigns, subject to the equities affecting the same respectively and I hereby declare that all receipts of the Trustees or Trustee for the time being of this my Will for all monies paid to them or turn under the same shall effectually discharge the purchaser or purchasers or other the person or persons paying the same monies from seeing to the application or being answerable for the mis- or non-application thereof

In Witness whereof I have hereunto set my hand the twenty third day of February one thousand eight hundred and fifty eight

Signed by the said Testatrix as her last Will and Testament in the presence of us present at the same time who at her request in her presence and in the presence of each other have subscribed our names as Witnesses the words ³& heredits² in the first side having been first interlined , G C Sharpen, Beccles, Suffolk, Sol, Charles Ream Arboretum Terrace, Ipswich, Clerk in General Post Office.

This is the first Codicil to the last Will and Testament of me, Ann Crickmay of Beccles, Widow which Will bears date the twenty third day of February, One thousand eight hundred and fifty eight

Whereas Edward Crickmay late of Norwich, Surgeon, one of the executors appointed by my said Will has removed to a distance,

Now it is my will that George Henry Crickmay of Eaton in the City of Norwich, Nurserymanıs Assistant, shall be substituted in the place of the said Edward Crickmay as one of the Trustees and Executors of my said Will and I direct that my said Will shall be read and construed as if the name of the said George Henry Crickmay had been inserted therein in the place and instead of the name of the said Edward Crickmay

And I confirm my said Will except as aforesaid In Witness whereof I have hereunto set my hand the sixth day of March One thousand eight hundred and sixty three

Signed by the said Testatrix, as and for a Codicil to her last Will and Testament, in the presence of us present at the same time who at her request in her presence and in the presence of each other have subscribed our names as Witnesses, Edwd Swatman Beccles, Suffolk, Solicitor, Isaac Vertigen Junr, Beccles, Suffolk, Clerk to the said Edwd Swatman

On the twelfth day of June 1863 the Will with a Codicil thereto of Ann Crickmay late of Beccles in the County of Suffolk Widow deceased who died on the ninth day of May 1863 at Beccles aforesaid was proved in the District Registry attached to Her Majestyıs Court of Probate at Ipwich by the Oaths of Robert Jarman of Beccles aforesaid Printer the Executor named in the said Will and George Henry Crickmay of Eaton in the City of Norwich, Nurserymanıs Assistant the Son of the deceased the Executor named in the said Codicil they having been first sworn duly to administer.
